Divorcing In Georgia

Georgia is a no-fault divorce state, which means that you can be granted a divorce without alleging fault within your marriage. However, in order to be issued a divorce, you must submit a reason to the court from among the list of thirteen valid reasons, which runs as follows:

  1. Intermarriage by persons within the prohibited degrees of consanguinity (relationship by blood) or affinity
  2. Mental incapacity at the time of the marriage
  3. Impotency at the time of the marriage
  4. Force, menace, duress, or fraud in obtaining the marriage
  5. Pregnancy of the wife by a man other than the husband, at the time of the marriage, unknown to the husband
  6. Adultery in either of the parties after marriage
  7. Willful and continued desertion by either of the parties for the term of one year
  8. The conviction of either party for an offense involving moral turpitude, under which he is sentenced to imprisonment in a penal institution for a term of two years or longer
  9. Habitual intoxication
  10.  Cruel treatment
  11.  Incurable mental illness
  12.  Habitual drug addiction
  13.  Or that the marriage is irretrievably broken.

Issue thirteen is the reason most often cited, which simply means that you and your ex have reached a point where your differences cannot be reconciled. 

You should also take into consideration that if there was some fault that led to the dissolution of your marriage, such as cruel treatment or habitual drug addiction, you can bring these issues to the court to potentially receive a more favorable divorce settlement.

Considerations When Divorcing

There are two maincategories of divorce in Georgia. Uncontested divorce occurs when you and your ex-spouse are aligned on issues such as child custody and division of assets, or work to align yourselves through mediation or negotiation. If there is nothing to dispute between the two of you, the process will be quicker and cheaper, and you will not have to go to court! 

Contested divorce occurs when you and your ex are in disagreement about one or more aspects of your divorce. This type of divorce is more complicated and can take much longer and cost more money. A judge will end up deciding on the terms of your divorce in court.
