How To Get Divorced In Georgia

Georgia is a no-fault divorce state, which means that you do not have to prove that your spouse is at fault for the dissolution of your marriage in order to be granted a divorce. However, you still have to submit one from a list of thirteen reasons to explain why your marriage is ending. The reasons are as follows:

  1. Intermarriage by persons within the prohibited degrees of consanguinity (relationship by blood) or affinity
  2. Mental incapacity at the time of the marriage
  3. Impotency at the time of the marriage
  4. Force, menace, duress, or fraud in obtaining the marriage
  5. Pregnancy of the wife by a man other than the husband, at the time of the marriage, unknown to the husband
  6. Adultery in either of the parties after marriage
  7. Willful and continued desertion by either of the parties for the term of one year
  8. The conviction of either party for an offense involving moral turpitude, under which he is sentenced to imprisonment in a penal institution for a term of two years or longer
  9. Habitual intoxication
  10.  Cruel treatment
  11.  Incurable mental illness
  12.  Habitual drug addiction
  13.  Or that the marriage is irretrievably broken.

If you are getting divorced because the differences between you and your spouse have simply become too vast or you have changed as people since getting married, you should cite the thirteenth reason, which does not seek to place blame.

However, if there is blame to be placed for the breakdown of your marriage, such as due to adultery or addiction, citing one of these other reasons might give you a better chance at earning marital assets that are important to you if the matter is taken to court.

Contested Vs. Uncontested Divorce

Our Conyers divorce lawyers can help you determine the route that your divorce should take. There are two main approaches to divorce.

Uncontested divorce occurs when you and your partner are in agreement on the terms of divorce, including issues such as child support and alimony. If the two of you agree, you do not need to go to court and submit to the ruling of a judge. This type of divorce tends to be easier, cheaper, and quicker, though it usually involves compromise.

Contested divorce occurs when you and your partner are not aligned on one or more of the terms of divorce. If you cannot come to an agreement, you will ultimately have to go to court and have your divorce ruled on by a judge. This type of divorce can be stressful and take a long time, but it can be worthwhile if you are ultimately entitled to terms that you prefer.

Whatever route your divorce takes, we can help you fight for what you need in order to begin the next chapter.

Lunn Law LLC is hands down the best law firm I’ve ever done business with. They are warm and inviting. I felt like I was part of the family. My very first consultation with attorney Tiffany Lunn-White started with her asking me to speak about myself personally. And that did it for me. They were very thorough and on point with everything I needed. I highly recommend this firm.
