SEPARATE MAINTENANCE ("LEGAL SEPARATION")
 

     A husband and wife may decide to remain legally married and not officially dissolve their marriage for a number of reasons. Those that want an alternative to divorce often decide to legally separate (i.e. Separate Maintenance).

     The legal process involved in a separate maintenance action is very similar to a divorce in Georgia. All issues such a property division, child support, alimony, and custody will be decided in a separate maintenance action as well. However, an important difference between a separate maintenance action and a divorce in Georgia is that there is no residency requirement to file the former.
